Agreement to terms

These Terms and Conditions govern your use of gilawp.com and any WordPress maintenance, development, audit, or related services provided by GILAWP (“we”, “us”, or “our”). By using our website or engaging our services, you agree to these terms.

Services

We provide WordPress maintenance plans, one-time audits (security, performance, and accessibility), malware removal, performance optimization, and related development services. The specific scope, deliverables, and pricing for any engagement are set out in the plan, quote, or proposal you accept.

Audits and reports

Paid audits (such as our $499 site or accessibility audits) are delivered as written findings within the timeframe stated at the time of purchase. Findings are provided for informational purposes; acting on any recommendation is optional and at your discretion.

Maintenance plans

Operate, Operate Pro, and Agency plans are billed monthly and are month-to-month unless otherwise agreed in writing. Development hours included in a plan do not roll over between billing periods. Work beyond your included hours is billed separately at our standard rate or scoped as a fixed-price project, always with your approval first.

Payment

Fees are due according to the terms specified in your plan or quote. We reserve the right to pause services for accounts with significantly overdue payment, with prior written notice.

Client responsibilities

  • Providing accurate account access and information needed to perform agreed work
  • Reviewing and approving quotes for work outside your plan’s included hours before it begins
  • Maintaining your own copies of credentials and content you consider critical, in addition to the backups we maintain

Cancellation

You may cancel a month-to-month plan at any time, effective at the end of your current billing cycle. Agency plans follow the cancellation terms specified in their annual agreement.

Limitation of liability

While we take significant care in staging, testing, and backing up before any change, no maintenance or development process can guarantee a site will never experience downtime or issues. Our liability for any claim relating to our services is limited to the fees paid for the specific service giving rise to the claim, except where limitation is not permitted by law.

No guarantee of specific outcomes

Where we describe expected outcomes (such as performance improvements or accessibility conformance), these are targets based on professional judgment and industry standards, not guarantees, unless a specific outcome is explicitly written into your agreement (as with the Core Web Vitals commitment available on Operate Pro).

Intellectual property and ownership

You retain ownership of your website, content, and accounts. Any custom code we write specifically for your site as part of a paid engagement becomes your property upon full payment, excluding any third-party or open-source components, which remain governed by their own licenses.

Termination

We may terminate services for non-payment, abusive conduct, or use of our services for unlawful purposes, with written notice where practicable.

Governing law

These terms are governed by the laws applicable in our jurisdiction of operation, without regard to conflict-of-law principles.

Changes to these terms

We may update these Terms and Conditions from time to time. Material changes will be reflected by an updated “Last updated” date at the top of this page.
